What Is DSEAR and Why Does It Matter?

The Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR) were introduced to ensure employers systematically identify, assess, and control risks to employees and others arising from fires and explosions involving dangerous substances in the workplace.

What Are Dangerous Substances?

Under the legislation, a dangerous substance is defined as any substance or preparation that can create a risk to safety due to its physical or chemical properties. This includes:

  • Substances or preparations that are explosive, flammable, highly flammable, or oxidising.

  • Substances or preparations that present a workplace risk because of how they are used, handled, stored, or are otherwise present, due to their physicochemical or chemical characteristics.

  • Dusts, including fibrous materials, fine solid particles, or similar substances, which may form explosive atmospheres when dispersed in air.

DSEAR Requirements for Employers

The Management of Health and Safety at Work Regulations 1999 place a legal duty on employers to manage risks to people in the workplace. DSEAR builds on this by applying those duties specifically to risks arising from dangerous substances.

Because dangerous substances can give rise to fires and explosions with potentially catastrophic consequences, including serious injury, loss of life, or long-term impacts on quality of life—they must be managed with a high level of care and control.

Under DSEAR, employers are required to:

  • Identify which dangerous substances are present in the workplace and assess the risks they pose.

  • Implement controls to eliminate those risks where possible, or reduce them to an acceptable level where elimination is not reasonably practicable.

  • Put measures in place to limit the consequences of fires, explosions, or other incidents involving dangerous substances.

  • Establish procedures for dealing with accidents, incidents, and emergency situations involving dangerous substances.

  • Ensure employees are competent to manage and control these risks through appropriate information, instruction, training, and supervision.

  • Identify, locate, and classify areas where explosive atmospheres may occur, and prevent the introduction of ignition sources in those areas through hazardous area classification and appropriate equipment selection.

The overall aim of a DSEAR assessment is to ensure the workplace is as safe as reasonably practicable, protecting workers and other relevant persons, such as contractors and members of the public—from harm arising from dangerous substances.
